Brent Ray Fraser (““BRF””) is pleased to provide these websites and on-line e-store (collectively, the ““BRF” Sites”). The following describes the terms (the “Terms” that govern your use of the “BRF” Sites, and the services and goods provided through the “BRF” Site). Your use of the “BRF” Sites constitutes your agreement to all of the Terms. If you (the ““Client””) do not agree with any of the Terms you may
not use the “BRF” Sites.
Use of the “BRF” Site
(a) Content
The information and materials contained at the “BRF” Site, including the text, images, arrangement and general design (collectively, the “Content”) are owned or licensed by the artist Brent Ray Fraser, and/or the artist’s heirs. You are authorized to view or download a single copy of the Content solely for your personal, educational, non-commercial use provided you retain all proprietary notices contained in the
Content. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content. Reproduction of the Content except as specifically provided in this paragraph is prohibited without the express written authorization of “BRF”, the copyright, and intellectual property owner. Any publication or commercial use of the Content is strictly prohibited. Copying, redistribution or exploitation of the Content for personal or corporate gain is not permitted.
(b) Prohibited Use
You may not use the “BRF” Site in any manner which is contrary to applicable local, provincial, national, international and foreign laws or regulations governing your use of the “BRF” Site. It is solely your responsibility to determine whether your use of the “BRF” Site is lawful. You may not use the “BRF” Site in any manner which could damage, disable, overburden or impair the “BRF” Site or interfere with any
other party’s use and enjoyment of the “BRF” Site.
(c) Prices and Orders
“BRF” reserves the right to change the prices, fees and charges regarding the goods and services available through the “BRF” Site (including the e-store) at any time and from time to time without any notice or liability to you or any other person. “BRF” cannot guarantee that goods or services advertised on the “BRF” Site will be available when ordered or thereafter. “BRF” also reserves the right at any time to reject, correct, cancel or terminate any order. If you order goods or services for which the price was incorrectly displayed, “BRF” will provide you with an opportunity to cancel your order. If you order goods or services that are not available, “BRF” will notify you by email with an expected shipping date. “BRF” reserves the right to limit quantities sold.
(d) Modification
“BRF” reserves the right to change or modify the terms, conditions, and notices under which you may use the “BRF” Site. “BRF” will post all changes or modifications to these Terms on the “BRF” Site. Each use of the “BRF” Site will constitute your acceptance of the Terms posted on the “BRF” Site at that time.

You credit card will be charged approximately 1 to 2 days prior to shipping. In the case of a partial
shipment you will only be charged for items shipped. All charges will be in Canadian dollars (CND).
(b) Additional Fees
All works of art, and products purchased are non-refundable. Each work/product will be properly packaged if it requires shipping, and all shipping costs, including duty, taxes, and insurance are the sole responsibility of the “Client”. “BRF” will not be held liable for any art works lost or damaged during shipping.
(c) Confirmation of Order
You will receive an e-mail confirmation of your order. Please note the Confirmation/Transaction Number for purposes of order tracking.
(d) Order Cancellation
Order cancellation will be accepted via email within 24 hours of initial placement of order.
(e) Shipping Policy
Shipping is available to most destinations within Canada, the U.S. and major International locations. Please allow up to 20 business days for delivery of items. All items will be shipped using UPS (United Parcel Service). For any international shipping, please contact “BRF” directly via email for a shipping quote.
(f) Prices and Orders
“BRF” reserves the right to change the prices, fees and charges regarding the goods and services available through the “BRF” Site (including the e-store) at any time and from time to time without any notice or liability to you or any other person. “BRF” cannot guarantee that goods or services advertised on the “BRF” Site will be available when ordered or thereafter. “BRF” also reserves the right at any time to reject, correct, cancel or terminate any order. 2. Live Performances/Events:
(a) All live performances/events require a non-refundable deposit of 50% of the total cost (CND), to secure the booking. Full payment must be received by ““BRF”” upon arrival to the venue, prior to the performance commencing. Failure to pay in full, will forfeit the performance. All travel and expense costs will be an additional charge, to be agreed upon between ““BRF”” and the ““Client””. In the event ““BRF”” is not able to perform on the pre-arranged date due to unforeseen circumstances he will make arrangements with the ““Client”” to reschedule the performance.
(b) The following live performances listed below require a non-refundable deposit as follows:
“Sweaty Cum Undies” Live requires a $1000.00 (CND) deposit to secure the booking*
“Hallelujah” Live requires a $1500.00 (CND) deposit to secure the booking*
*A bodyguard will accompany ““BRF”” during these two performances
3. Penis Statues:
Each Penis Statue is a work of art, and is meant for display purposes only. ““BRF”” will not be held liable for any injuries, or health conditions that may arise from, or are sustained by improper/misuse of the penis statue.
4. Installation Art Dildos:
Each Art Dildo is a work of installation art, not meant for personal use. Each Art Dildo is made of bodysafe silicone. “BRF” will not be held liable for any injuries, or health conditions that may arise from, or are sustained by improper/misuse of the Art Dildo.
5. Apothecaries:
“BRF” cannot be held criminally responsible for any misuse of his Apothecaries products. These products are a work of art intended for display purposes only, and are not meant to be opened, or for human consumption.
6. Performance Art Fitness Videos:
Each Art Fitness video is a work of art, to be viewed as a performance piece. Any dialogue is merely for the purposes of entertainment, and not meant to be instructional. “BRF” is not a professionally certified personal trainer, and will not be held liable for any injuries, or health conditions that may arise from, or are sustained by improper/misuse of the Art Fitness videos. The purchase of any/all Art Fitness videos is nonrefundable, for personal use only, and “BRF” is not liable for any incompatibility of software, or downloading issues. Licensed for private home exhibition only. Any public performance, copying, or other use is strictly prohibited. All rights reserved.
7. Custom Performance Art Videos:
A non-refundable deposit of 30-50% is required for any custom art video commissions, prior to work beginning, and requests must be submitted in writing to “BRF”. All requests are subject to approval by “BRF”, and once a deposit is received, the art video commission cannot be cancelled. The subject matter for the art video commission is to be agreed upon between “BRF” and the “Client”. As with any work of
art, a degree of artistic license by the artist (“BRF”) is to be expected. Payment in full is required to receive the art video. The completed art video will be sent by “BRF” to the “Client” via Drop Box or other secure means to be agreed upon by “BRF” and the “Client”, with any additional costs will be the responsibility of “Client”.
8. Clothing Purchases:
(a) Size Charts
For all clothing purchases, please refer to the sizing chart to ensure that an accurate fit is requested at the time of purchase. Each article of clothing for sale is an individual work of art, and non-refundable nor exchangeable.
(b) Shipping Costs
All shipping costs, duty, taxes, and insurance are the sole responsibility of the “Client”. For any international shipping, please contact “BRF” directly via email for a shipping quote.
9. Custom Commissioned Art Work

10. ALL CONTENT IS PROTECTED BY COPYRIGHT LAWS
Images, text, software, documentation, electronic text and image files, audio and video files and clips, and other materials on the “BRF” site are protected by copyright laws and may be covered by other restrictions as well. “BRF” retains all rights it may hold, including copyright, in data, image, text, and any other information contained in these files. Copyrights and other proprietary rights in the material on this website may also subsist in individuals and entities other than, and in addition to, “BRF”. “BRF” expressly prohibits the copying of any protected materials on this website, except for the purposes of fair use as defined in the copyright laws, and as described below.
FAIR USE IS PERMITTED
Fair use of copyrighted material includes the use of protected materials for noncommercial educational purposes, such as teaching, scholarship, research, criticism, commentary, and news reporting. Unless otherwise noted, users who wish to download or print text, audio, video, image and other files from the “BRF” site for such uses are welcome to do so without “BRF”’s express permission. Users must cite the
author and source of this material as they would material from any printed work; the citation should include the URL "http://www.brentrayfraser.com” or 'https://brentrayfrasershop.com/'.
By downloading, printing, or otherwise using text, audio, video, image and other files from the “BRF” Website, whether accessed directly from this website or via other sites or mechanisms, users agree that they will limit their use of such files to fair use, and will not violate “BRF”’s or any other party's proprietary rights.
COMMERCIAL USE IS RESTRICTED
Unauthorized publication or exploitation of “BRF”’s files is specifically prohibited. Anyone wishing to use any of these files or images for commercial use, publication, or any purpose other than fair use as defined by law, must request and receive prior permission. RESERVATION OF RIGHTS
All rights not expressly granted by “BRF” herein are specifically and completely reserved. Nothing on the “BRF” site or in these Terms and Conditions grants, expressly or implicitly, by estoppel or otherwise, any right or license to use any content or property of any third party, or may be construed to mean that “BRF” has authority to grant any right or license on behalf of any third party.
11. Your Information
(a) Personal Information
“BRF” is committed to protecting the privacy of its online guests and customers. We only collect personally identifiable information that you provide or that is otherwise provided to us on your behalf. Unless we advise otherwise, your information will only be used for the purpose for which it was provided or to contact you.
(b) E-Store Purchases
When you make a purchase we will ask you to provide only the personally identifiable information necessary to complete the transaction including your name, billing and shipping addresses, telephone number, and credit card number. We also require your e-mail address so you can receive order and shipping confirmation e-mails and so we can communicate with you if there is any follow-up required in processing your order.

13. Indemnity
You agree to indemnify, defend and hold harmless “BRF” and its respective agents, directors, officers, employees and licensors, and all other related, associated, or connected persons (collectively, the "Indemnified Parties") from and against any and all liabilities, expenses and costs, including without limitation reasonable legal fees and expenses, incurred by the Indemnified Parties in connection with any claim or demand arising out of, related to, or connected with the use of the “BRF” Site by you or your breach of this agreement. You will assist and co-operate as fully as reasonably required by the Indemnified Parties in the defense of any such claim or demand.

14. Miscellaneous
(a) Survival
The disclaimer, limitation of liability and indemnity provisions in these Terms will survive indefinitely after the termination of these Terms.
(b) Marks
Brent Ray Fraser and the “BRF” logo (collectively the “Marks”) appearing on the “BRF” Site are registered and unregistered trademarks, trademarks or service marks of Brent Ray Fraser. The use of the Marks is strictly prohibited without the prior written consent from “BRF”. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.
Nothing appearing on the “BRF” Site or elsewhere will be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Marks displayed on the “BRF” Site.
(c) Severability
If any provision of these Terms are invalid or unenforceable under applicable law, then it will be, to that extent, deemed omitted and the remaining provisions will continue in full force and effect.
(d) Entire Terms
Unless specifically provided herein, these Terms constitute the entire agreement between you and “BRF” with respect to your use of the “BRF” Site. These Terms will supersede all prior agreements, understanding, negotiations and discussions, either oral or written between the parties. There are no representations, warranties, conditions or other agreements, express or implied, statutory or otherwise, between the parties in connection with the use of the “BRF” Site except as specifically set forth herein.
(e) Termination
These Terms will automatically terminate if you are in breach of any of the provisions contained herein. “BRF” reserves the right, in its sole discretion, to suspend or terminate your access to the “BRF” Site and the related services or any portion thereof at any time, without notice. Upon any such termination you may no longer access and/or use the “BRF” Site.
“BRF” may, in its sole discretion, change, suspend or terminate, temporarily or permanently, the “BRF” Site or any part of it or any of its features at any time, for any reason, without any notice or liability to you or any other person.
If these Terms or your permission to use the “BRF” Site is terminated by you or “BRF” for any reason, these Terms will nevertheless continue to apply and be binding upon you in respect of your prior use of the “BRF” Site and your purchases of goods and services through the “BRF” Site and anything connected with, relating to or arising from those matters.
(f) Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You hereby expressly consent to the sole and exclusive jurisdiction and venue of the courts of the Province of British Columbia, located in the city of Vancouver for any legal proceeding arising out of or relating to your use of the “BRF” Site or these

Returns & Refunds
We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.
To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and Issues
We take care to ensure your artwork and order arrive safely and on time. Please inspect your order immediately upon reception and contact us right away if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
Exceptions / non-returnable items
Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders, commissions, or personalized items), and personal care goods (such as beauty products or our Apothecary collection items). We cannot accept returns or refunds on silicone dildo replicas or any dildo-related products. Please get in touch if you have questions or concerns about your specific item.
Unfortunately, we cannot accept returns on sale items, raffle products, or gift cards.
Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.
European Union 14 day cooling off period
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.
